Lead-Safe Certification

On July 22, 2021, Governor Murphy signed legislation known as the Lead-Safe Certification Act. The bill, which regulations are mandated and administered by the New Jersey Department of Community Affairs takes effect on July 22, 2022 for all rental properties built before 1978.

The law requires a primary prevention inspection process for rental properties built before 1978 and requires landlords to have a current Lead Safe Certificate at rental tenant turnover.

Every single family, two family & multi-family rental dwelling will be (initially) inspected for lead based paint hazards at rental turnover, or, if there is no rental turnover, they must be inspected within two (2) years of the effective date of the bill; no later than July 22, 2024.

After initial inspection, rental properties to be inspected every three (3) years, or upon subsequent rental turnover, whichever is earlier.

March 5, 2024:  On March 4, 2024, the New Jersey Department of Community Affairs Division of Local Government Services published the Certification of State Aid for Calendar Year 2024. The amount of Total Energy Tax Receipts allocated to Byram Township increased $2,884 to $582,337.  Since the budget was not introduced, it required an update of the budget to include the additional state aid prior to budget approval.  The amount of additional state aid was included and the amount to be raised by taxes was reduced.  The budget plan now has property taxes totaling $9,184,793.73 or 71.45% of the revenues. This a 1.19% or $107,904.73 increase of the tax levy.

Byram Township Soil Importation Ordinance: How It Affects You!

Background:

In recent years, the importation of contaminated topsoil and fill has resulted in the need for Byram Township to institute an ordinance that appropriately regulates the importation of topsoil and fill.  On December 6th, 2022, the Byram Township Council unanimously passed Ordinance No. 011-2022 creating Chapter 210 of the municipal code entitled "Soil/Fill Placement" and also amending chapter A287 of the municipal code to include soil/fill permit fees and escrows.

What does this mean for township residents:

The ordinance is designed to prevent uncontrolled placement and movement of soil and other mineral deposits that could have detrimental effects on the health, safety, and general welfare of the public.  Depending on the volume of soil in question, it is essential that soil movement and filling operations be reviewed by the Township Zoning Officer and/or Township Engineer through an appropriate permit process.  The provisions of Chapter 210 may not apply to minimal filling associated with landscaping activities that does not exceed the allowable volume of fill as defined in the table below during any 12-month period.  However, any person conducting such filling shall upon the request of Byram Township provide written proof that the soil or fill meets the New Jersey Department of Environmental Protection requirements, and this chapter of the township ordinance.

The provisions of this chapter shall not apply to excavations or fill for building foundations, septic tanks, or sanitary installations, provided that no such excavation or construction of any kind shall take place until a permit has been approved by the Construction Official and/or Department of Health as required by law.  Any soil/fill material used in conjunction with these activities, however, must be acceptable soil/fill which meets the requirements of § 210-6C (16).

However, any person conducting such filling shall, upon request of Byram Township, provide written proof that the soil/fill meets the NJDEP requirements of N.J.A.C. 7:26D, Remediation Standards, and this chapter.

BYRAM TOWNSHIP AFFORDABLE HOUSING:

Byram Housing Rehabilitation Program: The purpose of the Byram Housing Rehabilitation Program is to fulfill the rehabilitation portion of the Fair Housing obligations of Byram Township under the NJ Fair Housing Act and the Township's Housing Element and Fair Share Plan as submitted to and approved by the Superior Court.

Byram Township's Housing Rehabilitation Program provides eligible Township homeowners with interest-free loans up to $17,000 for basic home repairs.  Repayment of the loan is deferred until the home is sold.

Income eligibility for the Program is set by the State of New Jersey.  Current maximum income levels, depending on household size, can be found on the attached preapplication form.  Submitting a preapplication places you under no obligation to the program, it only establishes your place on the Program waiting list.  Applicants will be served in the order that their preapplication is received.

A Good Shake could save your Mail Box

Each winter, mailboxes are damaged during winter maintenance operations. More often than not, damage to mailboxes is caused by snow pushing against weakened posts or hardware. If you can shake your mailbox, it probably needs maintenance. Take time now to make any repairs needed so your mailbox will be strong enough to survive the winter. Proper maintenance may help to prevent damage that results in delayed mail delivery, or worse, having to make alternate delivery arrangements.  On “Shake Your Mailbox Day”, please give your mail box an aggressive shaking and a thorough inspection.

Owner Responsibilities and Requirements

It is the Owner or Contractor's responsibility to request all required inspections at least 24 hours prior to the time needed. Inspections are to be performed within (3) business days. Please call the Construction Office at (973) 347-2500 x123 for all inspections, and when the work is completed so a final inspection can be done and a Certificate issued. When calling for an inspection, leave permit #, block, lot, name of owner, and address. It is the owner's obligation to call this office every six (6) months maximum to let us know the status of the work. Failure to call for inspections and proceeding to the next phase of work is a violation of the code, and could result in a penalty and a termination of permit. If you have any questions in regard to permits, call the building department and they will let you know if a permit is required. The following are some common types of buildings that require permits:



Pools
Requirements: Zoning, Building, Electric, and Plumbing Permits
You must fill out zoning, building, electric and plumbing (if pool is heated) applications. Once the applications are approved, call x123 to schedule all inspections when: the hole is dug (if inground pool only) and a rough electric setup (trench dug with wires in hole, must be 18" deep) is completed. When pool is finished, call for final inspections.

Decks
Requirements: Building and Zoning Permits
Once application is approved, call for footing inspection (before concrete is poured). Call at the end of the job for final inspection.
